Lifting a Domestic Violence Restraining Order

 

When a domestic violence arrest is made, law enforcement is required to ask the alleged victim if a restraining order is desired. Often they will pressure the victim so that a restraining order is imposed whether or not it is really needed.

 

 

Later, police will follow up to determine if there has been contact after the restraining order was imposed. This can potentially expose the accused to additional charges or increased bail.

What is a Domestic Violence Restraining Order?

 

A restraining order is a California Court Order designed to help an alleged victim from being harassed.  Unfortunately restraining orders are often misused and cause unnecessary difficulties for a family.

 

Domestic Violence Restraining Orders are one of four types of restraining orders available in California.  The four types are:

 

  • Domestic Violence Restraining Order
  • Civil Harassment Restraining Order
  • Elder or Dependent Adult Abuse Restraining Order
  • Workplace Violence Restraining Order

 

According to California Domestic Violence Law, an alleged victim can request a Domestic Violence Restraining Order when:

 

  • He or she has been physically abused. This "abuse" can at times amount to a tiny scratch or bruise.
  • There is a close or family relationship between the people involved such as with married or registered domestic partners, people who are divorced, separated, dating or used to date, live together or used to live together, parent, child, brother, sister, grandmother, grandfather, mother-in-law or son-in-law. 
  • A roommate situation does not apply.
