I’VE BEEN ARRESTED IN SAN JOSE WHERE WILL MY COURT BE?

 

If you are accused of committing an offense in San Jose, your case will likely be dealt with at the Hall of Justice, at 191 West Hedding Street in downtown San Jose. Courthouses that deal with criminal matters are also located at Palo Alto, and South County Morgan Hill. Further, the Drug Court is held at the Terraine courthouse in Terraine Street, San Jose.

To find out which court you are in, you need to consult the Criminal Calendars. These are posted daily in the courthouses, and are also available online at the Superior Court of California, County of Santa Clara website. If you have an attorney representing you, however, they will keep you updated about all court appearances and whether you need to attend.

 

DO I HAVE TO ATTEND COURT, OR CAN MY ATTORNEY GO FOR ME?

 

In most misdemeanor cases you do not have to attend court if you have a lawyer – they can go on your behalf. The exception to that rule is if you have been charged with an offense involving domestic violence, or if the Judge orders you to appear. You must also attend court if you are facing a felony charge.

 

WHERE IS THE JAIL FOR SAN JOSE?

 

There are two county jails in San Jose, under the control of the Santa Clara County Sheriff. The Elmwood Correctional Facility, located in Milpitas, has complexes that house both male and female inmates. The Main Jail Facility is located on W. Hedding Street, in Downtown San Jose. All inmates are initially booked through the Main Jail.

 

CAN I LOOK UP THE COURT CALENDAR ONLINE?

 

Yes, in San Jose the Court Calendar is available online, here. Those list the cases that are scheduled for the next five days. However, if you have an attorney, they will advise you of all court dates well in advance.

 

HOW DO I VISIT SOMEONE IN JAIL IN SAN JOSE?

 

All visitors are required to schedule their visits in advance via the Sheriff’s Department. The Department allows visits to be scheduled online, here, as well as by telephone or by attending the visit office. If you do not know which jail someone is being held in, you can search for inmate booking information online through the Department of Corrections website, here. You will need either the inmate’s Person File Number (PFN), Booking Number (CEN), or their name and date of birth or booking date.

It is important that you know exactly where an inmate is held before scheduling a visit. This is because each jail has a different visiting hours schedule. The Elmwood Complex allows visits in different parts of the jail on different days throughout the week and weekend, and the Main Jail Complex allows visits at specified times throughout the week and weekends. When visiting an inmate, you must be aware of and comply with all of the rules concerning appropriate dress, and which items you are allowed and not allowed to take to the jail. If you violate the rules your visit will be cancelled.

 

HOW DO I HELP MY FRIEND OR RELATIVE BAIL OUT IN SAN JOSE?

 

An accused person’s bail is set either when they are booked, or when they have appeared before a judge. Thereafter, a bond needs to be paid for them to be released. When you retain Summit Defense Attorneys, we can refer you to a bail bonds company that we work with, and that gives our clients a discount.

If you, or a friend or relative willing to post bail, owns a home or other property, they may be eligible to post a property bond. If you want to know if a property bond is available in your case, you should consult your attorney.

In San Jose, you can post bail for any inmate at the Main Jail Complex, in Downtown San Jose. Bail can be posted 24 hours a day, 7 days a week, except between the hours of 2.00am and 5.00am when the office is closed.

 

CAN I LOOK UP MY SAN JOSE CRIMINAL RECORD ONLINE?

 

You cannot find your official criminal record online. You can, however, request a copy of your local criminal record from the County of Santa Clara Sherriff’s Office. It is best to make an appointment first, by calling (408) 808-4700, and then attend the office in person at 55 West Younger Avenue, San Jose. You should take identification with you, and be prepared to pay their required fee.

If you need a copy of your full and complete criminal record, such as for expungement proceedings, you need to make an application via the California Department of Justice. More information on the process can be found on their website, here. You will need to attend a livescan facility to be fingerprinted, and submit a form and the required fee.
