What is the DMV Administrative Per Se Hearing?
While everyone accused of DUI is automatically given a court date, the lesser known DMV Administrative Per Se Hearing is a discretionary action which means that it must be requested within 10 days to take place.
The DMV hearing specifically addresses the issue of whether your driver’s license will be suspended. It offers the accused a chance to assert his or her rights and present evidence to contest what would otherwise be an automatic license suspension! These two hearings are completely separate and a win at in a DUI court case does not automatically result in a win at a DMV hearing.
